One perpetuating factor is that some judges continue to accept confessions obtained through torture and ill-treatment, despite the fact the constitution prohibits the admission of such statements. Another is the failure to investigate and prosecute most torture cases.

The Mexican Human Rights Commission (CNDH) is an a public institution whose objective is to ensure remedies for human right abuses, reform of laws, policies, and etc. In the past they have made many reports on human rights abuses. For an instance, some reports were based on soldiers who had murdered citizens while "trying" to enforce the laws. The CNDH has routinely failed to execute successful remedies against those abuses and reforms.

The city of Juarez has a total population of 1.5 million people. It is the second-largest bi-national municipality. Juarez is one of the largest growing cities in the world. It is also considered one of the most violent places in the world outside of marked war zones. It is violent because it is a main transportation and entrance point to northern Mexico.
As of August 2009, Juárez's murder rate was the highest reported in the world, exceeding the holders of the second and third highest rates by more than 25%.
